how much can i sell homemade soy candles for?

How do companies market their own brands of a product without infringing on a patent?

I would like to start an online business selling different types of homemade candles. If I were to sell let’s say citronella based candles or soy based candles, or candles with multiple wicks, how is this done without infringing on a patent? I am trying to better understand why some products seem to be allowed to be copied, and others aren’t so that I don’t get myself into trouble. Any feedback and examples would be much appreciated!

Patents expire. Currently they expier 20 years from the date that the related patent application was filed (with the possiblity of a patent term extension if the patent office was slow in issuing the patent).

Also, patents are only issued to new and non-obvious inventions.

So, the products that you think are copied, might not have ever been patented, or if they were, their patents may have expired. Also, the manufacturer or seller of the copies may have paid the patent owner for a license to sell the copy.

Still further, the items you think are copies, might not be exact copies and might not include some aspect of the patented product.

The patent claims might call for 5 wicks and the copy might have only 3.
